This single page document embodies the terms and conditions of That Pool Heating Company Pty Ltd in relation to the supply and installation of goods.
Quotations
Quotations provided by That Pool Heating Company Pty Ltd are subject to a site visit and are valid for 30 days after the site visit.
All variations to quotations or orders must be made in writing and agreed by That Pool Heating Company and The Buyer at our discretion prior to supply and/or installation of the Goods. An amended Quote will be issued upon acceptance by That Pool Heating Company.
Prices may vary depending on the site coverage required, location and pool heating options. Prices are subject to change and will vary depending on the payment method chosen. If there is a product that is no longer available, the product will then be replaced or substituted based on customer’s request and is subject to their final approval.
The quote price for supply & install is based on an installation cost assuming there are no issues or additional construction or piping work.
If the Client has Pool heating provisions on site, the quote assumes that all equipment is in good working order. Any defects and further costs involved for the repair will not be the responsibility of That Pool Heating Company and additional costs may be added to the quote.
Payment Terms & Options
For the supply ONLY (no installation) or supply plus delivery, That Pool Heating Company requires Full Payment before shipment or collection of goods.
For the supply and install of pool heating systems, That Pool Heating Company requires a 10% Deposit of the Quotation to be paid prior to commencing the job. The Balance must be paid by the end of installation.
Payment Methods:
- Direct Deposit/internet banking (reference: invoice or quotation number) or,
- Credit card VISA or MasterCard (subject to an extra 1.5% transaction fee) or,

If the Buyer chooses to pay via Internet Banking, a copy of the electronic transaction receipt must be shown to That Pool Heating Company. The Buyer takes responsibility to check banking details and if there is sufficient money in the account. The Buyer is also required to state accurate quotation or invoice number as reference.
Overdue Payments:
Any accounts overdue past 7 days will be referred to a debt collection agency. In the event where your overdue account is referred to a collection agency and/or law firm, you will be liable for all costs which would be incurred as if the debt is collected in full, including commission on collection of the additional costs and also including legal demand costs.
The Buyer hereby acknowledges that the goods and services supplied by That Pool Heating Company shall remain the property of That Pool Heating Company until full payment is received. In the event of the Buyer defaulting in any terms of this agreement including the payment of any monies due under this agreement then we shall have the right (without serving notice) to retake possession of the goods supplied to the Buyer by us.
The Buyer hereby authorises and allows That Pool Heating Company or its representatives, servant, agent or employees to enter premises upon which the goods are housed or stored for the purpose of re-claiming possession of same and we shall not be liable for any costs, losses, damages, expenses or any other monies or losses suffered by the customer as a result of re-claiming possession of the goods.
Deposit
A contract for the sale and supply of products is entered between the Buyer and That Pool Heating Company when a deposit or full payment is received. A deposit or full payment indicates the acceptance of the Terms and Conditions stated here. The Buyer’s acceptance authorises us to proceed with the order. Accepted orders are subject to review by That Pool Heating Company Pty Ltd before commencement.
The confirmation of any payment made through an electronic instruction may not be received by us for reasons beyond either parties’ reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications, or the omission or failure of third-party website providers or systems.
Order/Job Confirmation
All orders are subject to confirmation and acceptance by That Pool Heating Company. We will email a confirmation of the receipt of payment once it has been processed by our accounting team.
Job Scheduling
We strive to achieve the highest standard possible in the supply and installation of products which have been purchased and all work will be carried out as directed by That Pool Heating Company unless specific instructions are written on this agreement or actual written specifications are given to us by the Client at point of sale.
We will schedule your job on our next available slot and email you a confirmation email with the date and hour of the installation. That Pool Heating Company takes no responsibility for delays due to any circumstances outside the control of That Pool Heating Company (e.g. weather conditions, stock availability, staff schedules).
The Buyer agrees not to hold That Pool Heating Company responsible for any delays with the supply or installation and agrees not to demand any compensation, whether monetary or otherwise. The customer also agrees not to withhold payment if, for any reason, a minor part of a customer’s order is delayed.
Job Installation
The Buyer agrees to provide access to the Installation Site between 6.00am to 5.00pm Monday to Friday or as otherwise agreed. The Buyer agrees to provide access Inside and outside the house (or as needed) and to remove any obstructions which could interfere with such installation or valuables which could be damaged. If our installer encounters any unforeseen difficulty with access or installation of the products ordered, the Buyer agrees to pay for any additional or removal costs that may arise.
All pets/animals should be kept away from the job site until completion to avoid any unforeseen accidents.
WARNING: Where concrete drilling and or cutting is required, That Pool Heating Company accepts no responsibility for, and shall not be held liable by you, should damage result to concealed services, such as power, gas, water etc. You indemnify us against all costs that may arise from such possible damages.
You should provide clear and accurate plans before we commence any such site works. (No rectification works are provided for, unless mentioned in proposal)
Cancellation/Return Policy
Under the Terms and Conditions of sale, we do not offer exchange or refund in any circumstances unless the item is faulty, significantly different from what was shown to you, not doing what it is supposed to do, in breach of manufacturer’s warranties or consumer guarantees, or where otherwise required by law (‘warranty returns’).
There are strictly no refunds in the case you have changed your mind or simply chosen a different product elsewhere.
You are entitled to a replacement or refund for a major failure, or to have the goods repaired or replaced if the goods fail to be of acceptable quality but the failure does not amount to a major failure.
For all warranty claims, please contact us directly and we will be able to advise you whether a refund, exchange, repair or replacement is available. We recommend you retain your purchase receipt as we may require proof of purchase.
Where a deposit has been received for pool covers and rollers, this deposit is non-refundable due to the nature of the product being custom cut-to-size. The Client is responsible for providing the accurate size required and That Pool Heating Company is not responsible for mistakes made by the Client in regards to pool covers and rollers sizes.
Warranty
All warranty periods commence from initial installation where goods have been supplied and installed.
Warranty period starts on the Date of Sale for the supply only of goods.
This warranty does not supersede any other remedy provided by law in the country where the product was purchased.
This warranty is applicable and available only to the original purchaser who bought the system directly from That Pool Heating Company. The warranty is not transferable except with the written consent from That Pool Heating Company.
That Pool Heating Company Pty Ltd ACN 638 658 278 warrants that the goods are fit for purpose and of merchantable quality.
That Pool Heating Company warrants that we are legally authorised to supply and install the goods in the Territory and to distribute them therein.
Specific Manufacturer Warranties apply to the goods purchased and are warranted by the Product Manufacturer. Client’s can download their Manufacturer Product Manual on our Warranty Page.
Warranty Claims:
Any warranty claim should be made in writing to That Pool Heating Company, with a copy of the original purchase invoice attached to contact@thepoolheatingcompany.com.au or via phone on 07 5649 6603.
That Pool Heating Company Pty Ltd will provide for the repair of any faulty or defective labour work, including the installation of the equipment, during the term of the warranty (12 months), subject to the “General Exclusions” stated below. Please note that all equipment defects or faults fall under the Manufacturing warranties and are back-to-base. Should a site callout be necessary, an invoice callout fee may be charged, in accordance with current service fees.
That Pool Heating Company undertakes to approve and provide repair work promptly, however we will not accept responsibility for any costs whatsoever in regard to any repair work or transport costs that were not carried by That Pool Heating Company or approved in writing by That Pool Heating Company. Work carried out without That Pool Heating Company’s written approval will void all warranties.
If the product has failed for a reason listed in the “General Exclusions” of the Terms and Conditions, the customer will be charged the reasonable costs incurred by That Pool Heating Company in testing, establishing product failure and repair.
General Exclusions:
That Pool Heating Company is not liable for the replacement or the repair cost or any consequential loss or damage caused by the following:
- Animals, birds, or falling debris.
- Events beyond normal working conditions, including fire, flood, vermin or insect infestation, thunderstorm activity and extreme weather (we recommend insurance inquiries with respect to such events).
- Electrical power surges or lighting strikes.
- Loss caused by normal wear and tear.
- Loss caused by theft.
- Loss and damage caused by excessive changes in moisture conditions around the perimeter of your home, that may cause the soil to shrink and swell, and affect the location of where your system is installed and damage its components.
- Damage caused by non-That Pool Heating Company authorised contractors. WARNING: the system must be installed in accordance with set procedures. Set procedures must also be followed during any subsequent moving, major repairs, or storage of the system (including the pump) to avoid damage.
- Pool water not being maintained at chemical conditions complying with the relevant Australian Standards regarding pool water quality. WARNING: Excessive chlorine levels can damage system components.
- Damage caused by severely overheating the product due to negligence, such as covering the product’s fans or vents with towels, clothing, or other objects.
- Damage caused by not turning your system in “Winter mode” during the cooler months.
- Any form of misuse, neglect, accident, theft or event beyond the control of That Pool Heating Company.
Liability
That Pool Heating Company shall not be liable for any loss of any kind whatsoever suffered by the Buyer as a result of any breach of any of the Company’s obligations under the terms and conditions, including any cancellation of the terms and conditions or any negligence on the part of the company, its agents or contractors, nor shall the Company be liable for any loss, damage or injury caused to the Buyer’s servants, agents, contractors, buyers, visitors, tenants, trespassers or other persons. The Buyer shall indemnify the Company against any claim by any such person.
Subject to the extent permitted by the Australian Consumer Law and the relevant state legislation, in no event shall That Pool Heating Company be liable for any other claims, injuries, or damages including, but not limited to, claims for faulty design, negligent or misleading advice, loss of profit, revenue or business, damages arising from loss or use of the product, and any indirect, special and consequential damages or injury to any person, corporation or other entity.
